These terms and conditions (the “Terms and Conditions” or “Agreement”) govern the use and purchase of goods from store.futurenrg.com.au (the “Site” or “Future NRG”). This Site is owned and operated by Future NRG Pty Ltd. This Site is an ecommerce website.
By using this Site, and purchasing goods from this Site, you indicate that you have read and understand these Terms and Conditions and agree to abide by them at all times.
eCommerce
No agreement will be formed until we process and accept an order and send confirmation to the customer that the order is complete.
The following terms and conditions apply to all the goods that are displayed on our Site at the time you access it. This includes all products listed as being out of stock. All information, descriptions, or images that we provide about our goods are as accurate as possible. However, we are not legally bound by such information, descriptions, or images as we cannot guarantee the accuracy of all goods we provide. You agree to purchase goods from our Site at your own risk. We reserve the right to modify, reject or cancel your order whenever it becomes necessary. If we cancel your order and have already processed your payment, we will give you a refund equal to the amount you paid. You agree that it is your responsibility to monitor your payment instrument to verify receipt of any refund.
Products
We make every effort to display as accurately as possible the colours, features, specifications, and details of the products available on the Site. However, we do not guarantee that the colours, features, specifications, and details of the products will be accurate, complete, reliable, current, or free of other errors, and your electronic display may not accurately reflect the actual colours and details of the products.
All products are subject to availability, and in some cases, we cannot guarantee that items will be in stock. We reserve the right to discontinue any products at any time for any reason. Prices for all products are subject to change.
Some products on our Site contains links to manufacturer websites that we do not own or control. We are not responsible for the content, policies, or practices of any website or service linked to on our Site.
Purchases And Payment
We accept the following forms of payment: Credit Card, Direct Bank Transfer. You agree to provide current, complete, and accurate purchase and account information for all purchases made via the Site. You further agree to promptly update account and payment information, including email address, payment method, and payment card expiration date, so that we can complete your transactions and contact you as needed. GST will be added to the price of purchases as deemed required by us. We may change prices at any time.
You agree to pay all charges at the prices then in effect for your purchases and any applicable shipping fees, and you authorize us to charge your chosen payment provider for any such amounts upon placing your order.
We reserve the right to correct any errors or mistakes in pricing, even if we have already requested or received payment.
We reserve the right to refuse any order placed through the Site. We may, in our sole discretion, limit or cancel quantities purchased per person, per household, or per order. These restrictions may include orders placed by or under the same customer account, the same payment method, and/or orders that use the same billing or shipping address. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers, or distributors.
Return/Refunds Policy
Refund requests must be made within 3 days after the receipt of your goods. We accept refund requests for goods sold on our Site only in the case that your goods have arrived broken. Refunds do not apply to sale items or because of change of mind.
Where a refund/return request has been accepted, you will adhere to the return instructions you receive from us. Return instructions will vary depending on the product type, weight, manufacturer warranties, location, and other extenuating factors. If applicable, returns can be made in person by visiting any of our Future NRG stores or they can made by mail. To return a good by mail, contact us for the return instructions as described above and post the item(s).
If a refund is approved, it is your responsibility to monitor your payment instrument to verify receipt of any refund.
We do not offer store credit.
Warranty
We are not responsible for product warranties. We do not repair or replace products under warranty. Where a product contains a warranty, it is the customer’s responsibility to submit, contact and process all warranty requests via the products manufacturer.
Repairs
The purchase of goods on our Site are supply only. We are not responsible for the repair of goods either within the manufacturers specified warranty period or thereafter.
Coupon Codes
At times we may issue coupon codes for the use of all users, restricted user accounts, and one-time codes for use during sale events. We reserve the right to modify and disable any coupon code at any time at our discretion.
Where coupon codes have been assigned to you as a restricted user, it is your responsibility to ensure the coupon code is kept safe and confidential for it’s continued use. Any breach in the use of a restricted user issued coupon code will result in the code being disabled, and termination of your restricted account.
Postage and Delivery
When you purchase goods from our Site, the goods will be delivered through one of the following shipping methods: Free Shipping or Flat Rate (Based on Zone).
Delivery will take place as soon as reasonably possible, depending on the delivery method selected. Delivery times may vary due to unforeseen circumstances. Please note that delivery times do not include weekends and public holidays. You will be required to pay delivery charges in addition to the price for the goods you purchase. You are required to provide us with a complete and accurate delivery address, including the name of the recipient. We are not liable for the delivery of your goods to the wrong address or wrong person as a result of you providing us with inaccurate or incomplete information.
User Data
Any information you share with us, input into our Site, or choose to store with us, will not be shared with any other entity outside of Future NRG for any purpose. The only exception to this is the necessary information required from financial institutions in relation to processing a credit card or online transaction. Future NRG will only use information you share with us to contact you regarding your purchase, sale offers, and other general correspondence.
Force Majeure
Future NRG shall not be liable in any manner whatsoever to the extent that it has been prevented from performing any obligation under this Agreement by reason of matters beyond its control.
Obtaining Of Information
The Customer agrees and authorises Future NRG to make any enquiries or conduct any searches of the Customer as Future NRG deems necessary in its absolute discretion prior to accepting any Order.
Relationship Of Parties
Nothing in this Agreement shall give rise to a partnership or relationship of employment between the Parties.
Waiver
Any failure or delay by Future NRG to exercise a power or right does not operate as a waiver of that power or right. The exercise of a power or right does not preclude either its exercise in the future of the exercise of any other power or right. A waiver is not effective unless it is in writing.
Reading Down Of Agreement
If a clause in this Agreement is unenforceable it must be read down so as to be enforceable or, if it cannot be so read down, it must be severed from this Agreement without affecting the enforceability of the remaining terms of the Agreement.
Complaints
Making a complaint
a) If you have a complaint relating to your goods or its purchase, you can make a complaint to us by contacting us via our contact details as set out on our website or on your order confirmation emails. You can notify us of your complaint by giving us written notice of this, by post, email, or via our website.
b) We will handle your complaint in accordance with the Australian Standard on Complaints Handling AS ISO 10002-2006.
c) If you are not satisfied with the outcome of your complaint, you can refer the complaint to the relevant Fair Trading or Consumer Affairs office in your state or territory.
Australian Consumer Law (ACL)
This Agreement shall comply with Australian Consumer Law.
Termination Of Agreement
Future NRG may terminate this Agreement immediately by giving written notice to the Customer if the Customer breaches its obligations under this Agreement where such breach is either not capable of remedy or, if capable of remedy, the Customer fails to remedy such breach within 14 days after receipt of written notice of such breach by Future NRG; or the Customer engages in any conduct (which includes any conduct by employees of the Customer) which in the opinion of Future is or might be damaging to the reputation of Future or any of the Products and or Services.
Jurisdiction
This Agreement shall be governed by the laws of Victoria and Australia.
Updates to Terms and Conditions
These Terms and Conditions may be amended from time to time in order to maintain compliance with the law and to reflect any changes to the way we operate our Site and the way we expect users to behave on our Site.
